一、自然情况
我叫徐寄萍、男、45岁，我爱人宋英、女45岁。现住辽宁省丹东市振兴区六道新村10号楼108室、电话13470050762。我俩人均系下岗职工，以卖每碗一元的玉米粥供养儿子上学。
我儿子徐峰、男、19岁，1987年11月6日生人，于2006年毕业于丹东市敬业高中，并参加了当年高考，被北京大学新起点学校法律系录取。暑假为解决家庭生计和筹措去北京上大学的费用，孩子到丹东乐购（超市）啤酒广场打工。
二、徐峰被杀人凶手用刀刺伤的起因及事实经过
1、案件起因
2006年7月7日凌晨左右，徐峰下班后，与其他一同下班的8名同事回家，在途经丹东市第二职业高中对面江边处时，走在前面的刘维鹏、刘占飞二人见隋冰（男，杀人凶手）与李文花（女）二人在吵架，李文花在一边哭，便上前问隋：“你干什么欺负女的？”隋答到：“你装什么灯？”说着说着，双方便动起手打了起来。徐峰和他一道同行的鞠云龙出自好意上前劝架拉架，并说：“别打了。”此时就见隋冰手持尖刀朝鞠云龙刺去，徐峰见状迈步上前欲将双方拉开，令徐峰万万想不到的是刺完鞠云龙的隋冰，紧接着又持刀朝空手前来拉架的他刺来，徐峰被刀刺中后，当即倒下，后被两名同事送往丹东市第一医院进行抢救，同时向公安机关110报警。
徐峰住院后，经丹东市第一医院诊断为“开放性腹部损伤、低血容量休克、胃贯通伤、动脉血管破裂、大肠刺伤”。鞠云龙也被刺成“脾脏破裂和血气胸”，两人均住院治疗，后经丹东市公安局法医鉴定中心定为重伤害。
2、110民警出警，杀人凶手移交派出所
110民警接到报案后，当即赶到了事发现场，并对两位受伤者作了询问……，110民警又与徐峰的同事一起先后到丹东驻军230医院，丹东市中医院等医院门诊部查找、指引、缉拿杀人凶手，最后在市中医院将正在包扎手受了伤的隋冰（隋冰的手是被自己拿的刀刺破了皮，出了血）堵在了处置室里，隋开始否认与他人打架并持刀伤人了，后经指认隋冰承认两位伤者均是他持刀刺伤的。当即110民警将犯罪嫌疑人隋冰和其他几名当事人一同移交给了丹东市公安局振兴区分局一经街边防派出所。

隋冰之父——隋庆安，原是丹东边防的干部，转业后系丹东市公安局元宝区分局七道派出所的民警。

2006年11月6日，徐峰的母亲宋英接到一经街边防派出所民警梁凯电话口头通知：“徐峰怎么没来？”宋英答：“徐峰在家打点滴。”梁凯说：“他必须来。”宋英问：“他来干什么？”梁凯说：“需要他签字办取保候审。”宋英说：我“我儿子又没犯罪，办什么取保候审？”梁凯说：“你今天不把他叫来，你就别走了。”无奈之下，宋英只好用电话让正在家中打点滴的徐峰乘车来一经街边防派出所，午后2时许，徐峰到达派出所，又见隔半小时左右，徐峰的爷爷（67岁）奶奶（67岁）也相继赶到一经街边防派出所，办案民警民警梁凯，赵万利自下午14时开始讯问，对身体尚未康复的徐峰进行体罚，不让其坐凳子，并拿出手铐子进行威胁，多次对其推搡和呵斥。徐峰的爷爷、奶奶、母亲见当时的徐峰脸色苍白，四肢哆嗦，在万般无奈的情况下，签了取保候审的字才被允许离开一经街边防派出所。回家的当晚徐峰便感觉腹部疼痛，11月7日清晨就开始出现便血吐血的症状，当天早晨再次住进丹东市第一医院外科。
11月18日因病情恶化，一直不见好转，经丹东市第一医院同意转外地继续治疗，先后到沈阳，北京，于2006年11月21日住进北京军区总医院外科。12月13日经北京军区总医院治疗好转出院。
5、罗织罪名，网上追逃
2007年1月2日被害人徐峰因感觉腹部不适和有少许便血在住进北京军区总医院。1月5日身体出现好转，但尚在就医治疗中的徐峰在北京被北京东城区公安局刑警以全国网上通缉犯名义逮捕，并当即强行办理了出院手续。
2007年1月10日17时左右，在北京看守所里羁押了长达6天的徐峰出现大量吐血、便血的症状，北京市看守所干警和医生立即将徐峰送至北京市公安医院，经检查，北京市公安医院无法医治，最终又将徐峰送往北京军区总医院进行抢救（此次仅北京看守所就垫付门诊费达1000余元）。
2007年1月11日下午16时许，医院向徐峰的父母下达了病危通知书，2007年1月21日对徐峰再次开腹手术，于2007年2月9日18时终因病情恶化经抢救无效死亡。
徐峰三次住院累计花销医药费约20余万元。
三、澄清事实、严肃法纪、严惩凶手、为死者伸冤
1、徐峰2006年9月7日因劝架、拉架而被隋冰手持尖刀刺伤（隋冰先是持刀刺伤鞠云龙在先，而后又连续第二次持刀伤人），其持刀伤人的行为并非偶然或过失，应属故意伤害之举。
2、徐峰的伤情，丹东市公安局法医鉴定中心已定性为：重伤害。（鞠云龙之伤，丹东市公安局法医鉴定中心也定性为：重伤害）
3、徐峰第一次因隋冰持刀伤人住院时间为：2006年9月7日至2006年10月8日；第二次办案民警头一天讯问、体罚，第二天因出现便血、吐血，住院时间为：2006年11月7日至2007年1月5日；第三次是在北京看守所期间出现便血、吐血而住院，时间为：2007年1月10日至2007年2月9日死亡之时止。
从上述三个阶段住院时间去调查，分析事情发展经过，特别是第二次住院及从丹东市第一医院转至北京北京军区总医院，这一期间是连续的，去北京军区总医院也是丹东市第一医院同意的；其家属徐峰的奶奶也将徐峰去北京就医一事告知了一经街边防派出所。那么，徐峰又因何案成了丹东市振兴区公安分局一经街边防派出所的“逃犯”呢？他这个“逃犯”都触犯了我国的哪些法律、法规、条款？
4、“逃犯”徐峰已在北京东城区被抓，羁押在看守所，丹东市振兴区公安分局一经街边防派出所此情况知道否？为什么长达6—7天的时间都不去北京将案犯押回案发地，依法办案呢？这正常吗？究竟意在哪般？北京东城区刑警多次电话催丹东去提，为什么迟迟不去？
5、2007年1月12日，丹东市振兴区人民法院以被告人刘维鹏等人犯有寻衅滋事罪作出（2007）兴刑初字第19号刑事判决书，但判决书对徐峰刀伤的形式未作出事实认定。
6、徐峰自2006年9月7日被隋冰持刀捅伤住院抢救治疗至2006年11月6日被丹东市一经街边防派出所传唤；至2007年1月5日被北京东城区刑警逮捕羁押；至2007年2月9日死亡至今，丹东市公安机关未对徐峰被隋冰持刀捅伤致死一案作出任何结论，致使持刀伤人的凶手至今逍遥法外。
7、 2007年4月10日，丹东市公安机局振兴分局控申处通知家属到分局听处理结果，我们听到的是经分局重新审理，以前办理的案件无错，徐峰的死不予立案。
四、徐峰家属现在处境
徐峰的爷爷、奶奶年逾七旬，三辈单传，徐峰死亡的消息穿来，起爷爷奶奶卧床一病不起；徐峰的父亲、母亲双双下岗，没有经济来源，自徐峰死后，债台高筑，其母精神失常；为抢救徐峰，起亲属花掉20多万元医药费，家境已经崩溃。
五、悲剧仍在重演
2007年5月15日，我与爱人携带准备好的控诉材料，满怀着期望与祈盼的心情来到辽宁省省委大院门前，准备向省委有关部门领导倾述我们这个不幸家庭所经历的磨难。然而令我们万万没有想到的是，在我们刚到省委大门口不久也就是上午9：00左右从里边忽然出来一帮警察，二话没说架着我们两口子就往省委信访局拖，边拖边撕打。刚到信访局楼内，有10多个警察不问青红皂白抓住我的脖领子便拳脚相加劈头盖脸向我打来。其中一名警察（后经打听得知该人名叫吕殿华）一拳打在我的脸上，顿时将我的右门牙打掉，左右两颗呀也都快脱落。紧接又一帮警察约五六人上前来继续殴打我，持续长达10分钟。我一边撕博，一边大喊“救命啊，警察打人了”。这帮警察刚一停手，第三帮警察又上来继续撕打我，其中一名警察向我的胸部猛击数拳，打的我连咳不止，口吐白沫，他们方罢手。这三帮警察持续殴打我长达半个小时，至今我的头部、胸口仍疼痛不止。我爱人在信访楼的走廊也未能幸免，也被几个男警察殴打月经失禁，内外裤均已湿透，脖子也被掐肿了。这场洗劫我们心灵上不仅受到了极大的惊恐与创伤，更多感到的是疑惑和愤慨。在党中央和国务院大力倡导人性化管理和构建和谐社会，要求司法机关以人为本，文明执法的今天，在堂堂的省委大门口，身为人民警察，竟在众目睽睽的光天化日下，对一个弱小的上访者大打出手，我们真不明白，他们到底要在为谁执法。
六、申诉人的几点要求
1、恳请领导督促有关部门依法行使权利，严肃法纪，对徐峰被刀伤致死一案依法立案侦察、审理维护法律尊严。
2、严肃法纪，将杀人凶手绳之于法。
3、按照国家的有关规定，判隋冰之父赔偿徐峰的医疗费，赔偿徐峰父母的经济损失。
对于上述事实，我们有大量的佐证和证人可以作证。我们再次强烈要求有关部门查清事实，严惩杀人凶手，为我们伸冤啊！
